1 Acceptance of Terms

By creating an account or using the GardenVibe app, you confirm that you are at least 9 years of age (or the age of digital consent in your country) and that you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the app.

2 Description of Service

GardenVibe is an AI-powered garden design companion that allows users to:

• Generate AI garden design concepts for various spaces including balconies, rooftops, backyards, and vertical gardens.
• Receive climate-based plant recommendations tailored to their local environment.
• Create detailed budget plans (Budget, Standard, Premium tiers) to recreate AI-generated garden designs.
• Explore and share garden designs in the community inspiration hub.
• Access gardening tips, plant care guidance, and design inspiration.

3 User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Keep your account credentials confidential.
• Notify us immediately of any unauthorized access to your account.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4 Subscriptions & In-App Purchases

GardenVibe may offer premium features through subscriptions or one-time in-app purchases processed via Apple's In-App Purchase system.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time through your Apple ID account settings.
• Refunds are handled in accordance with Apple's refund policy.
• Prices may change with prior notice. Continued use of the service after a price change constitutes acceptance of the new price.

5 AI-Generated Content

GardenVibe uses artificial intelligence to generate garden designs and recommendations. By using these features, you acknowledge that:

• AI-generated designs are creative suggestions and may not be suitable for all environments, climates, or local regulations.
• Plant recommendations are based on general climate data and should be verified with local horticultural experts before planting.
• Budget estimates are approximate and may vary based on your location, local market prices, and seasonal availability.
• GardenVibe is not responsible for outcomes resulting from the implementation of AI-generated designs in real-world settings.

6 User-Generated Content

You may share garden designs and content in the GardenVibe community hub. By sharing content, you:

• Confirm that you own or have the rights to share the content.
• Grant GardenVibe a non-exclusive, royalty-free, worldwide license to display and distribute your content within the app.
• Agree not to share content that is offensive, illegal, misleading, or infringes on third-party rights.

We reserve the right to remove any content that violates these Terms without prior notice.

7 Prohibited Uses

You agree not to use GardenVibe to:

• Violate any applicable local, national, or international law or regulation.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use automated tools, bots, or scrapers to access or collect data from the app.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Share false, misleading, or harmful content in the community hub.
• Use the service for any commercial purpose without our prior written consent.

8 Intellectual Property

All content, design elements, trademarks, logos, and technology within GardenVibe are the property of AVE Global LLC or our licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. This license does not grant you any right to reproduce, distribute, or create derivative works based on our content.

9 Disclaimer of Warranties

GardenVibe is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• The app will be uninterrupted, error-free, or free of viruses.
• AI-generated garden designs or plant recommendations will be accurate or suitable for your specific conditions.
• Results from using the app will meet your expectations or requirements.

10 Limitation of Liability

To the maximum extent permitted by applicable law, AVE Global LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use GardenVibe, including but not limited to damages resulting from reliance on AI-generated content, plant failures, or garden implementation outcomes.

11 Termination

We reserve the right to suspend or terminate your access to GardenVibe at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, our business, or third parties.

You may terminate your account at any time by deleting the app and requesting account deletion via support@gardenvibe.app.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable law.

13 Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of material changes through the app or via email. Your continued use of GardenVibe after such changes constitutes your acceptance of the updated Terms.
